auDA own ‘vidu.id.au’ and don’t obey their own policy rules.

auDA have been pounding owners of “.id.au” domain names hard over the past few months. We recently printed a list of “.id.au” domains they’ve deleted.

For twenty years, the Australian public have been allowed to purchase “.id.au” domain names if they’re;

(a) a match to a Person’s legal name, first name or family name;
(b) an acronym or abbreviation of the Person’s legal name, first name or family name; or
(c) a nickname of the Person.    
(d) personal interest or hobby.

However, in March this year, individuals could no longer register a name that refers to a “personal interest or hobby”, if their “.id.au” domain was created, renewed or transferred between registrants after 24 March 2022.

Poor “.id.au” holders were not given much notice about this. Some holders had owned their domains for decades.

No one knows who or why someone at auDA suddenly changed the “.id.au” policy rules to discriminate against them after decades?

Anyway, somehow this new rule has been rushed in an auDA seem to continue to target domain investors who legitimately owned “.id.au” domain names for many years, whilst letting other people who have clearly registered “.id.au” domain names incorrectly, keep their domains.

What’s worse still, is that auDA must think they’re above their own policy rules, because they own a few “.id.au” domain names themselves as an Organisation.

To this day, “.au Domain Administration Ltd” own vidu.id.au as an organisation with an ACN, which is AGAINST POLICY RULES to own as a “.id.au” domain name.

Some may think this is similar to a policeman who thinks he’s invincible speeding at 120km per hour in a 60 zone (he’s not!!). It appears that auDA don’t believe they have to obey their own rules. Yet, they’re suspending and deleting legitimate domain name holders’ “.id.au” assets left, right and centre at the moment.

auDA also own the domain audns.id.au as an organisation.

We are receiving many conflicting and inconsistent reports as to recent .id.au decisions.

For example, auDA have recently allowed the person who owns “pizza.id.au” to keep his domain, because he has told them “Pizza Head is my nickname” and he has chucked up this website;

Pizza.id.au is safe, according to auDA, as “Pizza Head”, the nickname, protects him.

We have a list of over 150 “.id.au” domains that are currently owned by companies with ABN and ACN information, that should clearly be deleted, but instead, auDA seem to only be targeting a particular select few “.id.au” holders.

Let’s hope auDA quickly become consistent in their domain crackdown and don’t allow one set of rules for some people, and discrimination for others who have had venomous vexatious complaints made against them.

In terms of some personal domain complaints I’ve had made against me recently, when asked to reveal who the complainants are, the auDA Complaints Manager simply states, “I cannot disclose that information, as per the requirements of AAP6 (the complainant did not consent to a secondary disclosure)- Use or disclosure of personal information.”

I’m not even sure the complaints made against me are real? How can I possibly know? Who can I trust and turn to to ensure they even exist?

No one.

As we reported yesterday, auDA managers are basically judge, jury and executioners and no one is checking their decisions and there is no ombudsman to turn to when they get it wrong, or if someone is being discriminated against, or if they are simply inventing policy meaning out of thin air.

At some stage, you will understand that auDA does what auDA wants. Follow the rules or not. They make up their own mind. There is no consequence. There is no one above them that is not afraid of them. auDA is protecting the Australian DNS which is considered critical infrastructure. No government body will go against that.

At best they will pay lip service to your complaints and then passive-aggressively just ignore you until you go away. At worst they will start to find licensing issues with your portfolio. If they cannot find issues they will “interpret” their subject policies in such a way that they will find a violation.

They don’t care what is printed, they don’t care what complaints are made. They don’t care about lawyers. They are a law to themselves and they have very deep pockets. You take it because there are no other options.

The only way to win against auDA is not to play.
